Laws That Protect Your Medical Record Privacy
There are several regulations that protect your rights as a person seeking treatment for addiction at a rehab facility. The Health Insurance Portability and Accountability Act of 1996, also known as HIPPA, is a federal law and applies to any rehab facility that receives federal assistance. Under HIPPA, your information cannot be disclosed without your written consent, including your medical records.
HIPPA protection means that:
- You can request that your information not be shared with specific people or entities, such as your insurance company or employer
- You have the right to know who has seen your medical information
- Your information can’t be shared in ways that don’t directly relate to your healthcare unless you give your consent
Another regulation that protects people in rehab is the Confidentiality of Alcohol and Drug Abuse Patient Records, which prohibits substance abuse programs from disclosing your treatment unless they have your consent.
It’s important to know that there are some unique exceptions to these regulations.
Your medical information may be disclosed if:
- You are convicted of child abuse or neglect
- You committed a crime
- If a court order is issued, among other rarer cases.
